Weather, marine-condition, delay and cancellation procedures.

WEATHER & MARINE CONDITIONS POLICY

1. Safety and Operating Conditions

Blue X Ocean Adventures operates marine and watersports experiences only when the authorized operating team determines that conditions are appropriate for the scheduled activity. Guest safety, lawful operation, equipment limitations, and local marine conditions take priority over maintaining a scheduled departure.

2. Conditions We Monitor

Conditions considered may include wind, waves, swell, currents, tides, lightning, thunderstorms, visibility, heavy rain, tropical weather, marine advisories, waterway restrictions, marine traffic, beach or marina conditions, and other factors relevant to the specific activity and operating area.

Conditions can change quickly. A forecast alone does not determine whether an activity will operate.

3. Who Makes the Operating Decision

The final operational decision is made by authorized Blue X operations personnel, the captain/guide/operator, marina or port personnel where applicable, or another authorized party responsible for safe operation.

Guests should not rely solely on a weather application, general forecast, conditions at their hotel, or conditions observed at another beach or marina to determine whether a Blue X activity is operating.

4. Light Rain or Cloudy Conditions

Light rain, clouds, or other minor weather conditions do not automatically require cancellation. If the authorized operating team determines that the activity can be conducted safely and lawfully, the reservation may proceed as scheduled.

5. Lightning, Severe Weather, and Unsafe Marine Conditions

Blue X may delay, suspend, relocate, reschedule, shorten, or cancel an activity when lightning, thunderstorms, high winds, unsafe waves or currents, reduced visibility, tropical weather, government restrictions, or another marine or safety condition makes operation inappropriate.

Participants must immediately follow instructions to stop an activity or return to shore, dock, marina, or another designated safe location.

6. Tropical Storms and Hurricanes

When a confirmed reservation cannot reasonably operate because of a tropical storm, hurricane, government closure, or related safety condition, Blue X will apply the applicable rescheduling or refund terms and mandatory consumer law.

7. Blue X Weather Cancellation

If Blue X cancels a confirmed activity because the authorized operating team determines that weather or marine conditions prevent safe or lawful operation, the guest will ordinarily be offered a reasonable rescheduling option or a refund for the affected Blue X activity, subject to the applicable booking terms and mandatory law.

If only part of a multi-service package is affected, the remedy may apply to the affected component unless the remaining package cannot reasonably be provided.

8. Guest-Requested Cancellation Based on Weather

If Blue X determines that the activity is operating safely but a guest chooses not to participate because of personal weather preference, fear of rain, cloud cover, temperature, or similar concerns, the guest-requested cancellation terms generally apply.

Blue X may make reasonable exceptions based on the circumstances, but a guest's personal weather assessment does not automatically convert the cancellation into a Blue X weather cancellation.

9. Delays and Temporary Holds

Marine conditions may require a temporary hold or delayed departure. Blue X will make reasonable efforts to communicate material delays and provide updated instructions.

When a delay becomes substantial and the activity cannot reasonably be completed, Blue X may offer rescheduling or another remedy consistent with the applicable booking policy.

10. Relocation or Modified Route

For safety or operational reasons, Blue X may use a different approved launch point, route, operating zone, or sequence when the change does not materially alter the purchased experience.

If a proposed change would materially alter the confirmed experience, the guest should be informed and given the options required by the applicable booking terms and law.

11. Shortened Activities

An activity may be shortened after departure if conditions unexpectedly deteriorate or an emergency or safety issue arises. Any refund, credit, or rescheduling decision will consider the amount of the experience delivered, the reason for termination, applicable booking terms, and mandatory law.

12. Third-Party Services

Hotels, resorts, transportation providers, marinas, photographers, and other third parties may have separate weather or cancellation policies. Blue X will apply its policy to the Blue X portion of a reservation and will communicate material third-party limitations when they form part of the booking.

13. Guest Responsibilities

Guests should monitor Blue X communications before departure, provide a working phone/WhatsApp number and email, arrive at the instructed location and time unless advised otherwise, and follow all safety and weather instructions.

Guests should use appropriate sun protection, hydration, clothing, and secure storage for personal items based on the conditions and activity.
